Know What Steps to Take After You Are Involved in a Car Accident

Whether you are at fault or not, you should know what to do in the event you are involved in a car accident. In the United States, there are about six million motor vehicle accidents each year. If you are in an accident, you should be aware of what steps to take immediately after the accident happens.

The following steps are the most important to take when an accident occurs:

1. Stop!

Never drive away from the scene of an accident. Even if it is a minor accident and there are no injuries or damage, stay at the scene. If someone hits your car and drives away, do not chase after them. Stop where you are, as long as it is safe, or if you are able to safely pull to the side, you should do so.

2. Protect the Scene

By setting up flares or keeping your flashers on, you can help to prevent any other accidents. If your lights do not work, storing a flashlight in your car will help to keep you safe as you wait for help if it is dark out.

3. Call the Police

Having the authorities respond to the scene of an accident is a good idea, even if there are no serious injuries. Sometimes you need a police report in order to file a claim with your insurance company. The vehicles involved in the crash should remain where they are, unless they greatly interfere with traffic. In Connecticut, the law states you have five days to report a motor vehicle accident if the property damage sustained exceeds $1000.

4. Accurately Record the Accident

When the police arrive on scene, it is important to tell the investigating officer exactly what happened. You should tell them how the accident happened to the best of your ability, making sure to be honest and never speculate or guess any of the facts. Be sure to state if you are injured, and if you are unsure, it is better to say you are unsure rather than "no" because pain might become apparent hours after the accident. You should make sure the statement by the other person involved is accurate.

5. Take Photos

You should always make sure to take photos of the damage to not only your car but the other vehicle(s) involved as well. If you have any injuries that are visible, you should document those as well. You can take these on your cellphone or any camera that will be able to take clear photos.

6. Exchange Information

Usually the police officer on the scene will gather this information and give you the police report number. But, if the police are not at the scene of your car accident, you need to obtain the name, address and telephone number of all persons involved in the accident. You will also need to collect the other drivers insurance information by asking to see their insurance card. The names and telephone numbers of witnesses may also be useful in the event there is an accident investigation.

7. Report to Your Insurance

Notify your insurance company as soon as you are able to. Many policies will require immediate reporting of any car accident. If you have “medpay” you will be required to submit any accident-related medical bills to your insurance company. Once the medpay benefits are used (if you have them), then private health insurance becomes your primary insurer.

8. Seek medical attention

Injuries from car accidents can appear hours or even days after the accident happens. Many times the day or two following the accident will be the most painful. Unless you are certain you have no sustained any injuries, you should get checked out at a nearby emergency room or by your doctor.

9. Keep Documentation

It is important to keep together all of your files, pictures, and documents relating to your car accident. Keep the claim number, the adjuster's name handling the claim, names and insurance information gathered, rental car receipt, medical bills, etc.

10. Protect Your Rights

One thing you might want to consider after you get into an accident is to consult your attorney. They can help to protect you in the event that the other driver takes action against you if the accident was your fault. Attorneys can also advise you on ensuring full compensation for your property damage and that you are getting proper medical attention.
